You can hear the music above water, but it is not as loud. Once you submerge your head the sound is much clearer, almost like surround sound. Are you going to be swimming laps or using it to surf?
If you don't intend to swim laps, the SwiMP3 Surf is the better choice. It uses ear plugs which not only keep water out of your ears, but also make it easier to hear the music above water.
